Pune, (Maharashtra) [India] December 03, 2025: Rest The Case hosted an insightful panel discussion on “The Living Constitution: How Flexible Is India’s Supreme Law in a Changing Society.” The session featured Adv. Saurabh Sharma, a seasoned practitioner, TEDx Speaker, and leader of JSSB Legal, and Adv. Adhiraj Surana, founder of Adhiraj Devraj Surana and Associates, and a respected expert in litigation and IPR.
The discussion opened with a reflection on what it means for the Constitution to be a living document in today’s rapidly changing social and technological landscape. Panelists explored how constitutional interpretation adapts to new realities, drawing on foundational judgments like Kesavananda Bharati and Puttaswamy.
Key themes included federal tensions between the Centre and States, the growing need for clarity in balancing rights with public interest, and the role of constitutional morality in shaping progressive judicial outcomes. Participants also examined whether India’s many amendments have strengthened or diluted constitutional values and whether emerging challenges like artificial intelligence, digital privacy, and environmental protection require new constitutional tools.
Offering his perspective, Adv. Saurabh Sharma remarked, “Flexibility is the Constitution’s greatest strength, but it must always bend toward the protection of rights and democratic principles.”
Sharing his view, Adv. Adhiraj Surana stated, “Our Constitution survives because it evolves, yet that evolution must remain grounded in its core promise of justice and equality.”
